Welcome to Current Power
These Terms and Conditions ("Terms") govern your access to and use of the Current Power mobile application ("App") and the Current Power electric vehicle charging network ("Network"), operated by Current Power Solutions LLC, a company registered in the Kingdom of Saudi Arabia under Commercial Registration No. 7053939190 ("Current Power," "we," "us," or "our").
By downloading, accessing, or using the App or Network, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the App or Network.
1. Definitions
- Account: A registered user account created on the App to access Current Power services.
- App: The Current Power mobile application available on iOS and/or Android platforms, enabling users to locate charging stations, initiate and manage charging sessions, and process payments.
- Charging Session: A single instance of electric vehicle charging initiated through the App or a Current Power station.
- CPO: Charge Point Operator — referring to Current Power Solutions LLC in its role as operator of the Network.
- DC Charging: Direct Current fast charging, enabling rapid charging of compatible electric vehicles.
- Hypercharger / Charger: A high-power DC charging station within the Current Power Network.
- Network: The network of electric vehicle charging stations owned, operated, or managed by Current Power across the Kingdom of Saudi Arabia.
- User: Any individual or entity that accesses or uses the App or Network.
- Vehicle: The electric vehicle registered and used by the User to access charging services.
- kWh: Kilowatt-hour, the unit of energy used to measure and bill Charging Sessions.
2. Account Registration
- To create an Account, you must be at least 18 years old and legally capable of entering into a binding contract.
- You must provide a valid mobile number registered in your name, a verified email address, and accurate personal information.
- You are responsible for maintaining the accuracy, completeness, and currency of your Account information. You must notify Current Power promptly of any changes.
- You are responsible for maintaining the confidentiality of your Account credentials and for all activities conducted under your Account.
- You must notify Current Power immediately at info@current-power.com of any unauthorized access to your Account or any security breach.
- Current Power reserves the right to suspend or terminate Accounts found to be inaccurate, fraudulent, or in violation of these Terms.
3. Use of the App and Network
- You may only use the App and Network in accordance with these Terms and all applicable laws and regulations of the Kingdom of Saudi Arabia.
- You warrant that you are authorized to operate any Vehicle you charge through the Network, whether personally owned, leased, rented, or otherwise.
- You must ensure your Vehicle is compatible with the charging standard and power level of the station before initiating a session.
- You agree not to use the App or Network to damage, disrupt, overburden, or impair any system, server, or infrastructure connected to Current Power.
- You agree not to attempt unauthorized access to the App, Network, or any systems associated with Current Power.
- You must comply with all safety instructions, warnings, and alerts displayed on or near Charging Stations or within the App.
- Misuse of Charging Stations, including physical tampering, unauthorized modifications, or deliberate damage, may result in Account suspension, financial liability, and legal action.
4. Pricing
- All pricing is displayed in Saudi Riyals (SAR) and is inclusive of Value Added Tax (VAT) at the applicable rate, unless explicitly stated otherwise.
- Charging Sessions are billed based on energy consumption (kWh), and may be subject to additional fees including but not limited to: idle/overstay fees, reservation fees, and applicable location surcharges.
- Applicable rates are displayed in the App prior to initiating a Charging Session and may vary by station, location, power level, and time of use.
- Current Power reserves the right to amend pricing at any time. Where practicable, a minimum of fourteen (14) days prior notice will be provided through the App or registered contact details.
5. Billing and Payment
- You agree to provide and maintain a valid payment method on your Account prior to initiating any Charging Session.
- You are responsible for all charges incurred through your Account, including applicable VAT and any other statutory charges.
- Payment is processed at the conclusion of each Charging Session or in accordance with any prepaid or subscription plan applicable to your Account.
- In the event of a payment failure, Current Power may retry the charge, suspend your Account, or both. Access to the Network may be restricted until outstanding balances are settled.
- Current Power reserves the right to apply late payment charges for costs incurred in recovering unpaid invoices.
- Refunds, where applicable, will be processed within fourteen (14) business days. Eligible refund scenarios include failed sessions where no energy was delivered. Contact info@current-power.com for refund requests.
6. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND NETWORK ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
- Current Power does not warrant that the App or Network will be uninterrupted, error-free, or free from technical faults.
- Current Power does not guarantee the availability of any specific Charging Station at any given time.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CURRENT POWER SOLUTIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL) ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE APP OR NETWORK.
- Current Power is not responsible for damage to your Vehicle, its battery, or any onboard systems arising from charging sessions, except in cases of gross negligence or willful misconduct by Current Power.
- Users must operate the charging equipment in strict compliance with the Vehicle manufacturer's specifications. Damage resulting from non-compliant use is solely the User's responsibility.
- Current Power's total aggregate liability to you for any claims arising under these Terms shall not exceed the total charges paid by you in the three (3) months preceding the event giving rise to the claim.
- In the event of a Charging Station malfunction, Users must cease use immediately and report the fault via the App or by contacting info@current-power.com
8. Indemnification
- You agree to indemnify, defend, and hold harmless Current Power Solutions LLC, its officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the App or Network; (b) your breach of these Terms; or (c) your violation of any applicable law or third-party rights.
9. Force Majeure
- Current Power shall not be held liable for any delay, interruption, or failure to perform its obligations under these Terms arising from events beyond its reasonable control, including but not limited to: natural disasters, extreme weather events, acts of God, government actions, regulatory changes, pandemics, cyberattacks, or utility failures.
- Current Power will make reasonable efforts to resume normal services as quickly as practicable following a force majeure event.
10. Service Availability and Maintenance
- Current Power will endeavor to provide continuous and reliable access to the App and Network; however, services may be temporarily interrupted for scheduled maintenance, upgrades, or emergency repairs.
- Where practicable, Current Power will provide advance notice of scheduled maintenance through the App or by other reasonable means.
- Current Power is not liable for any inconvenience, loss, or damages resulting from service interruptions, whether scheduled or unplanned.
11. Termination
- Current Power reserves the right to suspend or terminate your Account and access to the App or Network at any time, with or without cause, and with or without notice, including for violation of these Terms.
- You may request termination of your Account at any time by contacting info@current-power.com
- Upon termination, any outstanding balances on your Account remain immediately due and payable.
- Provisions of these Terms that by their nature should survive termination (including payment obligations, intellectual property, limitation of liability, and dispute resolution) shall continue to apply after termination.
12. Intellectual Property
- The App, Network, Current Power branding, trademarks, logos, and all Content are the exclusive property of Current Power Solutions LLC or its licensors and are protected by applicable intellectual property laws.
- You are granted a limited, non-exclusive, non-transferable, revocable license to use the App solely for personal, non-commercial purposes in accordance with these Terms.
- You may not reproduce, distribute, modify, create derivative works of, or commercially exploit any Content without the prior written consent of Current Power.
13. Third-Party Services
- The App or Network may integrate or link to third-party services, including map providers, payment processors, and analytics platforms ("Third-Party Services").
- Third-Party Services are governed by their own terms and privacy policies. Current Power does not endorse, control, or assume responsibility for the accuracy, availability, or practices of any Third-Party Services.
- You are encouraged to review the applicable terms and privacy policies of any Third-Party Services before use.
14. Governing Law and Dispute Resolution
- These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia.
- Any dispute arising out of or relating to these Terms or your use of the App or Network shall first be submitted to Current Power for resolution through customer support.
- If the dispute cannot be resolved informally within thirty (30) days, it shall be referred to the competent courts of the Kingdom of Saudi Arabia.
15. Data Protection and Privacy
- Current Power Solutions LLC collects and processes personal data in accordance with the Saudi Arabia Personal Data Protection Law (PDPL) and its implementing regulations.
- Details of the personal data we collect, how it is used, with whom it is shared, and your rights as a data subject are set out in our Privacy Policy, available at: www.currentpower.sa/privacy
- By using the App or Network, you consent to the collection and processing of your personal data as described in the Privacy Policy.
16. Amendments to These Terms
- Current Power reserves the right to update or modify these Terms at any time.
- Material changes will be communicated to Users through the App, email, or other reasonable means at least fourteen (14) days prior to the effective date of the change.
- Continued use of the App or Network following the effective date of revised Terms constitutes acceptance of the updated Terms.
- If you do not agree with the updated Terms, you must discontinue use of the App and Network and may terminate your Account.
